These Terms of Service (“Terms”) govern your use of goldcitygaming.com, our vending machines, and any purchase from Gold City Gaming (“Gold City,” “we,” “us”). By using our website, machines or services, you agree to these Terms.

Eligibility

You must be at least 18 years old, or use our site and machines with the involvement of a parent or guardian who accepts these Terms. You agree to provide accurate information when you order or contact us.

Products and Descriptions

We sell trading cards, sealed products, apparel, patches, accessories, mystery products and limited “drops.” We describe condition and contents as accurately as we can. Card condition (for example Near Mint or Lightly Played) is a good-faith grading by us and is subjective. Colors and images may vary from the physical item.

Gold City Gaming is an independent retailer. We are not affiliated with, endorsed by, or sponsored by the publishers or owners of any card game or franchise we sell. All trademarks and product names belong to their respective owners.

Sealed, Mystery and Random Products

Sealed boxes, packs, and mystery products contain randomized contents. We do not guarantee that any particular card, item or value will be found, and contents can vary in value. Odds and pull rates are set by the manufacturer, not by us.

Pricing, Availability and Errors

Trading card prices change with the market and may change without notice. If a product is listed at the wrong price or is out of stock, we may cancel or correct the order and will refund any amount charged. Limited drops, pre-orders and exclusives may be subject to per-customer purchase limits.

Orders and Payment

Placing an order is an offer to buy; we accept it when we ship or confirm it. We accept the payment methods shown at checkout and at our machines. You authorize us to charge the payment method you provide, plus applicable taxes and shipping. We may cancel orders we suspect are fraudulent or that violate these Terms.

Shipping and Risk of Loss

Estimated delivery times are not guarantees. Risk of loss passes to you when the carrier delivers the package to the address you provided. If a package arrives damaged or is lost, contact us within 48 hours of the delivery date (or expected delivery date) so we can help file a carrier claim. Please record an unboxing video for high-value orders.

Vending Machines

Purchases from Gold City vending machines are made by card or contactless payment and are final except for machine malfunctions. If a machine charges you and does not dispense, contact us within 48 hours with the machine location, date, time and amount and we will refund or replace the item.

Returns

Returns and refunds are governed by our Returns Policy, which is part of these Terms.

Memberships and Rewards

Gold City Passport and rewards programs have no cash value, are non-transferable, and may be changed or ended at any time. We may suspend accounts that abuse promotions, resell in bulk in violation of purchase limits, or provide false information.

Acceptable Use

You agree not to misuse the site or machines, interfere with their operation, attempt unauthorized access, use bots to bypass purchase limits, or use the site for unlawful purposes.

Intellectual Property

Our name, logo, website content, and original artwork are owned by Gold City Gaming and may not be copied or used without written permission.

Third-Party Links and Services

Our site may link to or use third-party services (such as maps and social media). We are not responsible for their content or practices.

Disclaimer and Limitation of Liability

Our site and products are provided “as is” to the fullest extent permitted by law. We are not liable for indirect, incidental, special or consequential damages, or for changes in the market value of collectibles. Our total liability for any claim is limited to the amount you paid for the product at issue. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify Gold City Gaming against claims arising from your violation of these Terms or misuse of the site.

Disputes and Governing Law

These Terms are governed by the laws of the United States and the state in which Gold City Gaming is headquartered. Before filing a claim or chargeback, please contact us so we can try to resolve the issue directly.

Changes to These Terms

We may update these Terms from time to time. The date above shows the latest revision; continued use means you accept the changes.
